Labour inspectorate ramps up well-being at work inspections

16-12-24

In early 2024, the Labour Inspectorate for Occupational Welfare Monitoring announced that it would carry out more random inspections. The FPS ELSD currently communicates a more systematic approach to visits, resulting in a higher number of inspections.

Inspectors analyse and evaluate organisations’ well-being policies during inspections by the Labour Inspectorate for Occupational Welfare Monitoring.
They also indicate if there are shortcomings or breaches of legislation. Shortcomings or infringements found during an inspection can result in a warning or the cessation of the activities.

The inspections are part of an inspection programme that started in 2022 to identify the extent to which sectors comply with well-being regulations through statistically significant sampling. To make those statistics more relevant, the FPS is ramping up the number of inspections.

What does the inspection entail?

Basic inspections consist of two parts:

  1. Administrative inspection: Documents required by well-being regulations are inspected during this part.
  2. Workplace inspection: Specific regulation areas are examined during a tour of the workplace.

Inspectors work with standardised checklists tailored to the nature of the site:

  • Checklist for companies
  • Checklist for temporary or mobile construction sites

The checklists are only available in Dutch (click here) and in French (click here).

Please note: These checklists are for guidance; the inspection may make other additional determinations not mentioned on these lists.

How do I prepare for this?

Employers wishing to prepare can access the checklists in advance via the FPS website. Based on this, you can determine actions to be taken.
